SCOPE OF THIS NOTICE

Please read this Privacy Notice ("Notice") carefully to understand our policies, standards of practice, and how we handle your Personal Data. This Notice applies to individuals who interact with CJ Foods Vietnam Co., Ltd. and its affiliates and related businesses ("CJ Foods Vietnam," "We") as consumers ("you"). This Notice explains how CJ Foods Vietnam collects, uses, and discloses your Personal Data. It also informs you about how you can access and update your Personal Data and make decisions about how your Personal Data will be used.

This notice covers our online and offline data collection activities, including Personal Data that we collect through various channels such as websites, applications, third-party social networks, Customer Support Services, points of sale, and events. Please note that we may aggregate personal data from different sources (websites, live events). As part of this activity, we consolidate Personal Data that was originally collected by CJ Foods Vietnam or various partners of CJ Foods Vietnam. Please see Section 9 for how to opt-out of this.

If you do not provide the necessary personal data (in which case we will specify this to you, for example, by stating this information on our registration forms), we cannot provide our goods and/or services. This notice may change from time to time (see Section 11).

1. SOURCE OF PERSONAL INFORMATION

This notice applies to Personal Data that We collect from or about you, by the methods described below (see Section 2), from the following sources:

CJ Foods Vietnam Websites. Consumer-facing websites operated by or for CJ Foods Vietnam, including those We operate under our own domains/URLs and mini-sites We run on third-party social media networks including, but not limited to, Facebook, Tiktok, Youtube, Google, Zalo (“Websites”).

CJ Foods Vietnam Website/Mobile Application. Consumer-facing pages operated by or for CJ Foods Vietnam.

Email, phone messages, or other electronic messages exchanged between you and CJ Foods Vietnam via electronic communication.

Data and information collected from your communication with CJ Foods Vietnam Customer Care.

Direct Registration Forms. Paper or electronic registration forms and similar formats that We collect, for example, by mail, in-store advertisements, contests, events, and other promotional activities.

Advertising interactions. Interactions with our advertisements (e.g., if you interact with one of our ads on a third-party website, we may receive information about that interaction).

Data that we generate. In the process of interacting with you, we may generate Personal Data about you (e.g., your purchase activity from our websites).

Data from other sources. Third-party social networks (e.g., Facebook, Instagram, Google, YouTube, TikTok, Zalo, etc.), market research (if responses are not anonymized), third-party data collectors, CJ Foods Vietnam's advertising partners, open sources, and data acquired when we acquire other companies.

2. PERSONAL DATA WE COLLECT AND HOW WE COLLECT IT

Depending on how you interact with CJ Foods Vietnam (online, offline, by phone, etc.), we will collect various types of information from you, as presented below.

2.1. Basic Personal Data:

Personal contact information. Including any information you provide that allows Us to contact you, such as your name, mailing address, email address, social media information, or phone number.

Account login informationAny necessary information for you to access your account profile. For example, login ID/email address, display name, unrecoverable password, and/or security questions and answers.

Demographics and preferences. Any information that describes your demographic and behavioral characteristics. For example, date of birth, age or age range, gender, preferred products, hobbies and interests, family information, or lifestyle.

Information from computer/mobile device. Any information about the computer system or other technology device you use to access one of our websites, such as the IP address used to connect your computer or device to the Internet, the type of operating system, and the type and version of web browser. If you access the CJ Foods Vietnam website using a mobile device such as a smartphone, the information collected, if permitted, will also include your device's unique ID, advertising ID, and similar mobile device data.

Websites/Information Using Communication When you access and interact with our websites or newsletters, we use automated data collection technologies to gather certain information about your activity. This information includes: which links you clicked on, which pages or content you viewed and for how long, and similar usage data and statistics regarding your interactions, such as the number of replies to content, download errors, and the time spent on certain pages. This information is collected through automated technologies like cookies and web beacons, and uses third-party tracking services for analytics and advertising. You have the right to refuse the use of such technologies; for more details, please see Section 4.

Market Research & Consumer Feedback Any information about your experience with our products and services that you voluntarily share with us.

User-generated contentAny content that you create and then share with Us on third-party social networks or upload to one of our Websites or applications, including the use of third-party social media applications such as Facebook, TikTok. For example, images, videos, personal stories, or similar content. When permitted, We will collect and disclose User-Generated Content related to various activities, including contests and promotions, community website features, consumer interactions, and third-party social networking connections.

Third-party social media informationa. Any information you publicly share on a third-party social network or information on your profile on a third-party social network (such as Facebook, TikTok, Zalo) that you allow that social network to share with Us. For example, your basic account information (name, email address, gender, date of birth, city of residence, profile picture, user ID, friend list, etc.) and any other information or activity that you allow the third-party social network to share. We receive your third-party social network profile information (or a portion thereof) each time you download or interact with CJ Foods Vietnam's application or website on a third-party social network such as Facebook, TikTok, Zalo, each time you use a social network feature integrated into CJ Foods Vietnam's page (such as Facebook, Google, Zalo connect) or each time you interact with Us via a third-party social network. To learn more about how CJ Foods Vietnam obtains your information from third-party social networks or to opt-out of sharing such information from those networks, please visit the relevant third-party social network website.

Calls between you and Customer Care. Communications with CJ Foods Vietnam’s Customer Service department may be recorded or monitored, in accordance with applicable laws, for internal operational purposes (such as quality assurance or training). Payment card information will not be retained. If required by law, you will be informed that the call is being recorded at the start of the call.

2.2. Sensitive Personal Data:

Geolocation Information. We collect geolocation information to fulfill orders and/or transactions that you and CJ Foods Vietnam have agreed upon (such as awarding prizes in marketing programs, etc.).

Payment and Financial Information. Any information we need to fulfill your order, or information you use to make a purchase, such as debit or credit card information (cardholder name, card number, expiration date, etc.) or other forms of payment (if applicable). In any case, we or our payment service provider(s) will process payments and financial information in accordance with applicable laws, regulations, and security standards, such as the Payment Card Industry Data Security Standard (PCI DSS).

Please note that, in accordance with the law, we require your explicit and voluntary consent in advance to process Sensitive Personal Data (for example, for the purpose of carrying out a transaction agreed upon between you and CJ Foods Vietnam). If we process your sensitive personal data for other purposes, such processing will be based on the following legal grounds: (i) the detection and prevention of crime (including the prevention of fraud); and (ii) compliance with applicable laws.

We do not collect personal data directly from individuals under the age of 18 for marketing and communications purposes.

3. CHILDREN’S PERSONAL INFORMATION

We do not intentionally collect personal data from children under the age of 16. If we discover that we have inadvertently collected personal data from a child under the age of 16, we will promptly delete that personal data from our records. However, CJ Foods Vietnam may collect personal data about children under the age of 16 directly from their parents or legal guardians with their explicit consent, in accordance with applicable laws.

We do not collect personal data directly from individuals under the age of 18 for marketing and communications purposes.

4. COOKIES AND SIMILAR TECHNOLOGIES, LOG FILES, AND WEB BEACONS

Cookies and Similar Technologies. Please see our Cookie Notice to learn how to manage your cookie settings and for detailed information about the cookies we use and their purposes.

Log Files. We collect information in the form of log files that record activity on the website and gather statistics about your browsing habits. This information is automatically generated to help us fix errors, improve performance, and maintain the security of our website.

Web Beacon. A web beacon (also known as a “web bug”) is a string of code that displays an image on a webpage or in an email for the purpose of transmitting data back to us. Information collected through web beacons includes your IP address and details about how you interact with email campaigns (for example, when an email was opened, which links you clicked in the email, etc.). We use web beacons on our website or embed them in the emails we send to you. We use web beacon information for various purposes, including but not limited to reporting page views, counting visits, advertising, email tracking and reporting, and personalization.

Contests, marketing activities, and other promotional programs. With your consent (when required), we use your Personal Data to provide you with information about our products and services (such as marketing communications, marketing campaigns, or promotional materials). This may be done through various means, such as email, advertisements, SMS messages, messages via social media channels, phone calls, and postal mail, in accordance with applicable laws. Accordingly, as our customer, you may receive promotional information. Some of our campaigns and promotional programs run on third-party websites and/or social media platforms. The use of your Personal Data described above is voluntary, meaning you may object to (or, in certain countries, withdraw your consent for) the processing of your Personal Data for this purpose. For more details on how to change your marketing communication preferences, please see Sections 9 and 10 below. Third-party social media platforms. We use your Personal Data when you interact with third-party social media features, such as the “Like” button, to serve you ads and connect with you on third-party social media platforms. You can learn more about how these features work, the data profiles we have about you, and how to opt out by reviewing the privacy notices of the relevant third-party social media platforms. We use your Personal Data to personalize and provide information to you—including through social media—based on your preferences and interactions with our products and services.Personalization (offline and online). With your consent (when required), we use your Personal Data to (i) analyze your preferences and habits, (ii) predict your needs based on an analysis of your profile information, (iii) improve and personalize your experience on our websites and apps; (iv) ensure that the content on our websites and apps is optimized for you and for your computer or device; (v) provide you with targeted content and advertisements; and (vi) allow you to use interactive features, when you choose to do so. For example, we remember your login ID, email address, or display name so you can quickly log in the next time you visit our site or easily retrieve items you’ve added to your shopping cart. Based on this type of information, and with your consent (where required), we also provide you with specific content or promotional campaigns from CJ Foods Vietnam that have been tailored to your interests. The use of your Personal Data is voluntary, meaning you may object to the processing of your Personal Data for this purpose. Order completed. We use your Personal Data to process and ship your orders, provide you with order status updates, verify your exact address and identity, and carry out other anti-fraud measures. This includes Other general activities (such as internal research or market research, analysis, and security). Under current law, we use your Personal Data for other general business purposes, such as maintaining your account, conducting internal research or market research, and measuring the effectiveness of advertising campaigns. If you have multiple CJ Foods Vietnam accounts, we reserve the right to consolidate those accounts into a single account. Legal reasons or mergers/acquisitions. In the event that CJ Foods Vietnam or its assets are acquired by or merged with another company, including in the event of bankruptcy, we will share your Personal Data with any of its legal successors. We will also disclose your Personal Data to third parties (i) when required by applicable law; (ii) when necessary to comply with legal process; (iii) when necessary to respond to requests from competent enforcement authorities; (iv) to protect our rights, privacy, safety, or property, or those of the public; or (v) to enforce the terms of any contract or the terms on our website.•Legal Obligations

6. DISCLOSURE OF YOUR PERSONAL DATA

In addition to CJ Foods Vietnam companies mentioned in the Data & Contact Manager section (see Section 12), we share your Personal Data with the following third-party organizations:

Service Providers. We have partner companies that we use to support our business (e.g., order fulfillment, payment processing, marketing programs, fraud detection and identity verification, website operations, market research companies, logistics services, advertising, web development, data analysis, cycle counting, etc.). Service providers and their designated employees are only permitted to access and use your Personal Data on our behalf for certain required tasks, based on our instructions, and are required to keep your Personal Data confidential and secure. Where current law requires, you may obtain a list of providers processing your Personal Data (see Section 12 by contacting Us).

Credit reporting agencies/debt collection agencies. To the extent permitted by applicable law, credit reporting agencies and debt collection agencies are outside companies that We use to verify the reliability of your ability to pay (especially for invoiced orders) or to collect unpaid invoices.

Third-party companies use Personal Data for their own marketing purposes. Unless you have consented, we do not license or sell your Personal Data to third-party companies for their marketing purposes. The identities of these companies will be disclosed when you consent.

Third parties receive Personal Data for legitimate purposes or merger/acquisition. We will disclose your Personal Data to third parties for legitimate reasons or in the event of a merger or acquisition (see Section 5 for more details).

7. PERSONAL DATA STORAGE

Under current Vietnamese law, CJ Foods Vietnam will use your Personal Data if necessary to fulfill the purpose for which the Personal Data was collected (as stated in Section 5) or to comply with current legal requirements. Personal Data used to provide you with a personalized experience (see Section 5 for more details) will be stored for a period permitted by current law.

8. DISCLOSURE, STORAGE, AND/OR TRANSFER OF YOUR PERSONAL DATA

We employ appropriate measures (as described below) to keep your Personal Data secure and safe and to minimize potential risks such as your Personal Data being collected and processed in violation of applicable laws and regulations. However, please note that those safeguards do not apply to information that you choose to share in public areas such as third-party social networks.

Those who can access Your Personal Data. Your Personal Data will be processed by our authorized personnel or representatives, on a need-to-know basis, according to the specific purpose for which Your Personal Data was collected (e.g., customer service personnel will access your consumer profile).

Measures are taken in an operational environment. We store your Personal Data in an operational environment using reasonable security measures to prevent unauthorized access. We follow reasonable standards to protect Personal Data. However, the transmission of information over the Internet is not completely secure and although We will do our best to protect your Personal Data, We cannot guarantee the security of data transmitted via our website/app.

Measures we ask you to take. You also play an important role in keeping your Personal Data secure and safe. When registering for an online account, please ensure you choose a strong password and do not share your password with others. You are responsible for keeping your password confidential and for the use of your account. If you use a shared or public computer, please do not select the "remember me" option for your login ID/email address or password, and ensure you log out of your account when you leave the computer. You should also set or control the privacy settings on our Web site/app.

Transfer of Your Personal Data. Due to the international nature of our business, we may need to transfer your personal data internally within CJ Foods Vietnam (inclusive of CJ Group) and to third parties as described in Section 6, in connection with the purposes set forth in this Privacy Notice. We may therefore transfer your Personal Data to countries where the legal provisions and compliance requirements for data are different from those in the country where you reside, provided that all requirements for the transfer of Personal Data under the laws of the host country are met.

9. YOUR RIGHTS

  • The right to request access to or a copy of your Personal Data processed by CJ Foods Vietnam or on behalf of CJ Foods Vietnam;
  • The right to request information about the origin of your Personal Data, if that Personal Data was not collected directly from you;
  • The right to request correction of any inaccurate information in Your Personal Data.
  • The right to request information about the existence of, and explanation of the logical connections relating to, any automated processing of personal data that has legal effects or significantly affects you, and any anticipated consequences;
  • The right to request withdrawal of consent, deletion of your Personal Data, or request the Processing of your Data will be restricted for certain purposes.
  • The right to lodge a complaint about the processing of your personal data with a supervisory authority.
  • Other rights as provided for by current law.

Please note that any identifying information provided to Us will only be processed in accordance with and to the extent permitted by applicable law.

10. YOUR CHOICES REGARDING OUR USE AND DISCLOSURE OF YOUR PERSONAL DATA

We strive to provide you with choices regarding the Personal Data that you provide to Us. The following mechanisms enable you to control your Personal Data:

Cookies/Similar Technologies. You manage your consent via (i) a consent management solution or (ii) your browser to reject all or some cookies/similar technologies, or to inform you when they are being used. Please see Section 4 above.

Advertising, Marketing, and Promotions. You may agree to allow CJ Foods Vietnam to use your Personal Data for the promotion of CJ Foods Vietnam's products or services by selecting the relevant checkbox(es) on registration forms or by responding to questions posed by our customer care representatives. If you decide you no longer wish to receive such notifications, you may unsubscribe from marketing communications at any time by following the instructions provided in each communication. To unsubscribe from advertising notifications sent from any medium, including third-party social media, you may opt-out at any time by unsubscribing via the provided links in the communications, logging into the third-party websites/apps or social media and editing user preferences in your account profile by opting out of the relevant boxes, or by calling our Customer Care Department. Please note that, even if you opt out of advertising notifications, you will still receive administrative notifications from Us, such as notifications concerning your account activities (e.g., account confirmation, password changes, etc.), and other important non-marketing-related notifications.

Personalization (Offline and Online). Where required by law, if you wish for CJ Foods Vietnam to use your Personal Data to provide you with personalized and targeted content and advertising, you may indicate this through the check box(es) on the registration form or by answering the question(s) posed by our customer care representatives. If you decide that you no longer wish to benefit from personalization, you may opt-out at any time by logging into the website/app and adjusting the user preferences in your account profile by unchecking the relevant box(es) or by contacting our CES.

Targeted Advertising. We partner with advertising networks and other advertising service providers ("Advertising Providers") to serve ads on behalf of us and other companies on the Internet. Some of these ads are customized based on information collected over time from your activity on CJ Foods Vietnam's site or unaffiliated sites. You may also opt-out of our collection of precise location data from your mobile device by adjusting the location services settings on your device.

11. CHANGES TO THIS NOTICE

If we change how we handle your Personal Data, we will update this Notice. We reserve the right to change our practices and this Notice at any time, please check back for updates or changes to the Notice.
